1. Introduction
These Terms of Service ("Terms") govern your use of the Outdoor & Co. website and your purchase of products from us. By accessing this website or placing an order, you agree to be bound by these Terms.
Outdoor & Co.'s separate Returns and Refund Policy governs product returns and is incorporated by reference. In the event of any conflict between these Terms and the Returns and Refund Policy on the subject of returns, the Returns and Refund Policy prevails.
2. Website Use
2.1 Acceptable Use
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of this website by, any third party.
2.2 Prohibited Conduct
You must not:
- Use this website in any way that causes, or may cause, damage to the website or impairment of its availability
- Use this website to copy, store, host, transmit, or distribute any material that is unlawful, harmful, or infringes any third party's rights
- Conduct any systematic or automated data collection activities (including scraping, data mining, and data extraction) without our express written consent
- Attempt to gain unauthorised access to any part of this website, the server on which it is hosted, or any server, computer, or database connected to it
2.3 Accounts
If you create an account on this website, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use of your account.

All content on this website, including text, graphics, logos, images, and product designs, is the property of Outdoor & Co. or its licensors and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.
4. Orders, Pricing and Availability
4.1 Order Acceptance
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, stock unavailability, or suspected fraudulent activity.
4.2 Pricing
Prices are listed in Australian dollars (AUD) and are inclusive of GST unless otherwise stated. We reserve the right to change prices at any time without notice, though changes will not affect orders already confirmed.
4.3 Product Descriptions
We make reasonable efforts to ensure product descriptions, images, and specifications are accurate. Minor variations in colour, grain, texture, or dimensions may occur due to the natural properties of materials used, photography, or display settings.
5. Payment
5.1 Accepted Payment Methods
We accept payment via the methods displayed at checkout, which may include credit/debit card, digital wallets, PayPal, and third-party Buy Now, Pay Later (BNPL) services.
5.2 PayPal and BNPL Services
Where you choose to pay using PayPal or a third-party Buy Now, Pay Later (BNPL) service, your agreement for that payment arrangement is with PayPal or the BNPL provider directly, and their terms and conditions apply in addition to these Terms.
6. Promotions
6.1 General
From time to time, Outdoor & Co. may offer promotional discount codes, offers, or incentives ("Promotions") through email marketing, pop-ups, social media, or other channels. Each Promotion is subject to the specific terms stated at the time and place it is offered (including on the relevant pop-up, landing page, or email), which form part of these Terms.
6.2 Eligibility and Use
Unless otherwise stated in the specific terms of a Promotion:
- Promotional discount codes are limited to a single use per customer.
- Where a Promotion is stated to apply to a customer's first order, it may only be redeemed on that customer's first order and cannot be applied retrospectively to a prior order.
- Promotions apply to the price of eligible products only and do not apply to shipping, delivery, or other charges.
- Promotions have no cash value and cannot be redeemed or exchanged for cash, in whole or in part.
- Promotions cannot be combined with any other discount code, promotion, or offer unless expressly stated.
6.3 Expiry and Changes
Promotions are valid only for the period stated in the relevant offer. Outdoor & Co. reserves the right to modify, suspend, or withdraw any Promotion at any time without notice, including where required due to technical error, suspected misuse, or an error in the terms of the Promotion as communicated.
6.4 Misuse
Outdoor & Co. reserves the right to refuse or cancel an order, or to void a discount applied to an order, where it reasonably suspects a Promotion has been used fraudulently, in a manner inconsistent with its stated terms, or otherwise in breach of these Terms.
7. Product Warranty
7.1 Structural Warranty (24 Months)
Outdoor & Co. warrants that the following components will be free from defects in materials and workmanship for a period of twenty-four (24) months from the date of purchase:
- Aluminium frames, legs, and structural components
- Teak, timber, and wooden components
- Wicker and PE (polyethylene) wicker frames and structures
- Ceramic, glass, and stone tabletops and surfaces
- Metal hardware, fittings, bolts, and fasteners
- Rope structural components
7.2 Soft Goods Warranty (12 Months)
Outdoor & Co. warrants that the following components will be free from defects in materials and workmanship for a period of twelve (12) months from the date of purchase:
- Cushions and cushion covers
- Seat foam, padding, and filling materials
- Upholstery fabrics and textiles
- Decorative rope and textile weaving (non-structural)
- Egg chair hanging components
7.3 Warranty Exclusions
This Limited Warranty does not cover:
Normal Wear and Tear
- Fabric fading, creasing, pilling, or stretching over time
- Cushion compression and foam settling
- Minor surface scratches, scuffs, or marks from regular use
- Timber weathering, silvering, or greying when exposed to elements
- Natural variations in timber grain, colour, or texture
- Leather fading, creasing, scars, marks, or natural colour variations
- Minor variations in product size or weight (up to 5%) from display models
Improper Care and Maintenance
- Failure to follow care and maintenance instructions provided by Outdoor & Co.
- Use of harsh chemicals, solvents, abrasive cleaners, or inappropriate cleaning products
- Failure to oil or seal timber furniture as recommended
- Failure to cover or protect furniture from weather when recommended
- Storage in damp, poorly ventilated, or inappropriate conditions
Environmental Damage
- Prolonged exposure to direct sunlight causing fading or degradation
- Damage from extreme weather conditions (storms, hail, flooding, high winds)
- Salt spray or coastal environment damage when furniture is not properly maintained
- Exposure to temperatures outside the range of 0-35°C
- Mould or mildew growth from improper storage or failure to dry cushions
- Damage from fire, extreme heat, extreme cold, or bright artificial lighting
Stains and Spills
- Stains from acid, solvents, dyes, corrosive materials, ink, paint
- Stains from sunscreen, tanning lotions, sun prevention products, or bodily fluids
- Food and beverage spills not cleaned immediately
- Oil, grease, or chemical stains
Misuse and Damage
- Use beyond intended purpose or exceeding weight capacity
- Abuse, dropping, crushing, impact damage, or contact with hard surfaces
- Using furniture as a ladder, step stool, or standing surface when not designed for such use
- Damage from pets (scratching, chewing, etc.)
- Accidental damage or partial failure
- Damage during transportation or moving after delivery
Modifications and Alterations
- Products that have been altered, modified, or repaired by anyone other than Outdoor & Co. or authorised agents
- Use of incorrect accessories or parts
- Incorrect assembly or adjustment
- Removal or alteration of serial numbers or identifying marks
Display and Floor Models
- Products sold "as-is," marked as display models, clearance items, or floor stock
7.4 Warranty Claims
Making a Claim
To make a warranty claim, the customer must:
- Contact Outdoor & Co. at info@outdoorandco.com.au within the applicable warranty period
- Provide proof of purchase (receipt, invoice, or order confirmation)
- Provide clear photographs showing the alleged defect
- Provide a detailed description of the issue
Claim Assessment
Outdoor & Co. will assess the claim and may require additional information or inspection of the product. Outdoor & Co. reserves the right to determine whether a defect is covered under this warranty.
Remedies
If Outdoor & Co. determines that a product defect is covered under this warranty, Outdoor & Co. will, at its sole discretion:
- Repair the defective component
- Replace the defective component
- Replace the entire product
- Provide store credit for the purchase price
- Provide a refund (full or partial) for the purchase price
Shipping Costs
The customer is responsible for all shipping costs associated with warranty claims, including shipping defective products to Outdoor & Co. for inspection and return shipping of repaired or replacement products.
7.5 Warranty General Terms
Transferability: This warranty is non-transferable and applies only to the original purchaser with valid proof of purchase.
Warranty Period Commencement: Warranty periods commence on the date of original purchase as shown on the proof of purchase.
8. Returns and Refunds
Returns and refunds, including the 30-day money back guarantee, change of mind returns, and defective/damaged product remedies, are governed by our separate Returns and Refund Policy.
9. Australian Consumer Law
This Limited Warranty is in addition to, and does not limit, your rights under the Australian Consumer Law. Those statutory guarantees, which exist separately from this warranty, cannot be excluded, and are set out below.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.
A major failure includes situations where:
- The product is significantly different from the description or sample shown
- The product is substantially unfit for its normal purpose and cannot easily be fixed
- The product is unsafe
10. Limitation of Liability
To the maximum extent permitted by law, Outdoor & Co.'s liability under these Terms and the warranty set out in Section 7 is limited to the remedies set out in Section 7.4. Outdoor & Co. is not liable for:
- Consequential or indirect damages
- Loss of use, revenue, or profit
- Cost of substitute products or services
- Damage to property
- Inconvenience or time lost
Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot be excluded, restricted, or modified under the Australian Consumer Law.
11. Changes to These Terms
Outdoor & Co. may update these Terms at any time. Changes will be posted on the website and apply to purchases made after the effective date of the change. These Terms constitute the entire agreement between Outdoor & Co. and the customer regarding website use and product warranty, and supersede all prior representations or agreements on those subjects.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
